"description": "
The right to privacy is a fundamental human right recognized by both international and national laws. While the right is recognized for all humans as an inalienable and inherent right, determining the content and scope of the right may be dependent on the nature of relationship a person is in. Under this thesis, the researcher examines the adequacy of laws governing the right to privacy in the workplace in Ethiopia, specifically in the context of telecom companies, and identifies gaps if any while making recommendations for improvement. The study aims to provide insight into the content and limits of employees' right to privacy under international, and national laws. It also explores the sufficiency of Ethiopia's laws in protecting workplace privacy and offers recommendations for employers to ensure a balance between privacy rights and organizational needs. The researcher primarily employs doctrinal and qualitative research methodology.The finding of the research shows that the current legal avenue and the practice exhibits varies gaps in the protection of workplace privacy and demand immediate attention by all stakeholders including lack of explicit determination on the applicability of the Personal Data Protection Proclamation; the Ethiopian Communications Authority facing operational constraints despite a broad regulatory scope; limited human rights protection in labor laws with minimal reference to privacy rights; employees' limited awareness and defense of their privacy rights, unregulated secret surveillance practices by employers; unclear guidelines on the use of company communication resources; and the lack of clear guidance on accessing employees' personal data. The study concludes that the principles of legitimacy, proportionality and transparency are crucial for balancing the conflicting interests of workers and employers. It also recommends telecom companies to reconsider their policies and actions to create a better working environment, and that Ethiopia's governments study the matter further and take appropriate actions, including developing sector-specific directives or guidelines, empowering stakeholders and raising stakeholder awareness.
\n
",
